PRIVACY STATEMENT

The Kabacan Water District commits to protect the privacy of personal information of our customers, employees, and stakeholders pursuant to the provisions of the Republic Act No. 10173 of the Philippines or the Data Privacy Act (DPA) of 2012, its implementing rules and regulations, and related issuances. The Kabacan Water District also commits to guarantee the free flow of information as required under the Freedom of Information Act (EO No. 2, s.2016) and to protect and respect the confidentiality and privacy of these data and information.

Changes to this Privacy Statement

Kabacan Water District may modify or amend this statement whenever deemed necessary. If significant changes are made, we will provide notice by posting on our office, website, and official Facebook page. It is encouraged that you regularly visit our website and follow our Facebook page for the latest information.

Information We Collect and Process

Kabacan Water District collects your personal information when you apply for or avail of any product or service that we offer or when you interact with our employees. This may include, among others:

  • Personal details such as your name,  address (including nearest landmarks), contact numbers, e-mail address, specimen signatures, date of birth, age, sex, citizenship, civil status, education, employment details, fingerprints, and photographs;
  • Personal information connected with your Kabacan Water District Customer Account;
  • Other personal details such as your latest Community Tax Certificate (CTC), one (1) pc. latest 2×2 picture and nearest accounts water bill;
  • Copy of proof of lot ownership where service connection will be installed such as TCT, Deed of sale, Certifications, and other pertinent documents;
  • Sensitive Personal Information such as government-issued identification number which we use for identity verification purposes. 
  • For senior citizens, we collect your OSCA/DSWD ID to establish qualification for a senior citizen discount;
  • Images captured by KWD office CCTV and other similar recording devices and procedures installed by the office;
  • Any information regarding the computer system or other technological equipment you use to visit the KWD website and its sub-domain, such as your IP address and location, operating system version, and web browser; and
  • Any other information provided by the suppliers, vendors, and consultants to determine capacity to provide products and services, and other information required by government transactions.

Collecting Personal Information

Kabacan Water District collects your personal information only when you give your consent by signing our consent form and when you provide it directly to us.

We collect your personal information through:

  1. The information you provide us in relation to the frontline services we render;
  2. Personal interaction with our employees such as interviews, responses to our Customer Satisfaction Survey (CSS), and the like;
  3. Communication lines utilized by the district, such as mobile phone and email;
  4. Personal Data Sheet and/or Resume of aspiring applicants for employment submitted to Kabacan Water District;
  5. Visitors’ log book registration;
  6. Contact Tracing System Platform registration;
  7. Online payment platforms and collecting agents authorized by Kabacan Water District;
  8. Contract or agreement with us including an employment contract or other contracts to avail of our services or provide product or services to us;
  9. Our website, online platforms, social media, and other online presence by employing data collection methods such as cookies and Google Analytics; and
  10. Publicly disclosed personal information from all forms of media available.

Using Personal Information

Kabacan Water District collects your personal information for the following purposes:

  • Assessment on water service application and the like.
  • Create, administer, and maintain your customer account (KWD application software)  with the district.
  • As a reference for communication that is related to the application process, consumption and billing, notices, and other necessary documents for the continued use of our products and services.
  • To enable the district to respond to queries, requests, complaints, and other related concerns of the concessionaire.
  • To comply with government and other regulatory requirements and to establish, exercise, or defend legal claims and other activities permitted by law or with your consent.
  • To evaluate and recruit human resources
  • To be a respondent in interviews and Customer Satisfaction Surveys.
  • To establish the identity of guests and visitors and recording the purpose of the visit and other security purposes.
  • To maintain or update vendor/supplier account information and establish business relationships.

Your personal information shall not be used for any purpose that is contrary to the law or in any manner which you were not notified of.

Sharing Personal Information

Your personal information may be shared and disclosed subject to the provisions of the Data Privacy Act of 2012 and with your consent to the following:

  • Kabacan Water District’s employees who may require it to perform official duties.
  • Third parties that support the services we provide.
  • Anyone you give us permission to share with it.
  • Only when required by the law, rules, and other lawful orders and processes, law enforcement, and government authorities.

Your personal information shall never be sold and we take measures to keep your information safe and secured.

Storing and Protecting Personal Information

The personal information gathered in physical or printed form shall be stored in a secured location and locked filing cabinets with restricted access. 

All personal information collected in digital/electronic form is held in on-premise computers and secured data servers with limited physical access.

We implement appropriate physical, technological, and procedural safeguards.

We implement periodic and mandatory training of our employees on how to properly handle and protect your personal information.

Though it is impossible to guarantee the security of any computer system, we commit to maintain and implement robust and appropriate security measures and policies designed to uphold confidentiality, integrity, and availability of all personal information.

Retention and Disposal

Personal information shall be kept only for the time necessary to fulfill the purpose for which it was obtained, or as required by any duty or relevant laws, and shall be disposed of in compliance with Republic Act 9470 or the National Archives of the Philippines Act of 2007. Personal information on data subjects shall be disposed of in a secure manner to avoid further processing, illegal access, or disclosure to a third party.

Your Rights 

As a data subject whose Personal Information has been and will be collected and processed by us, you are entitled to the following rights, pursuant to Section 16 of the DPA and Section 34 of its Implementing Rules and Regulations:

  • Right to be Informed. As a data subject, you have the right to be informed whether personal data shall be, are being, or have been processed, including the existence of automated decision-making and profiling.
  • Right to Object. You have the right to object to the processing of your personal data, including processing for direct marketing, automated processing, or profiling.
  • Right to Access. You have the right to find out whether an organization holds any personal data on its computer database and/or manual filing system and if so, gain reasonable access to them.
  • Right to Rectification. You have the right to dispute the inaccuracy or error in your personal data and have the personal information controller correct it immediately and accordingly unless the request is vexatious or otherwise unreasonable.
  • Right to Erasure or Blocking – You have the right to suspend, withdraw or order the blocking, removal, or destruction of your personal data.
  • Right to Damages. You have the right to claim compensation for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use or disclosure of your personal data.
  • Right to Data Portability. You have the right to obtain and electronically move, copy or transfer your personal data in a secure manner for further use.
  • Right to File a Complaint  – You may file a complaint if you are the subject of a privacy violation or personal data breach, or who are personally affected by a violation of the DPA.

No Personal Information shall be collected without your consent. If you wish to withdraw consent to the collection of your Personal Information, kindly give us reasonable notice to allow time to cease any and all processing.

Any information to be provided by you shall always be in clear and plain language, to ensure that the information is easy to understand and access.
